Summary

A comparative legal analysis by Fasken law firm examining AI regulatory frameworks across Canada and major international jurisdictions as of late 2022. The resource surveys emerging legislation, proposed rules, and policy approaches to AI governance, highlighting similarities and differences between Canada's Artificial Intelligence and Data Act (AIDA) and frameworks in the EU, US, UK, and China.

Key Points

  • Compares Canada's proposed AIDA (part of Bill C-27) with the EU AI Act, US executive guidance, UK principles-based approach, and China's algorithmic regulations
  • Highlights Canada's risk-based regulatory approach for 'high-impact' AI systems, requiring transparency, human oversight, and bias mitigation
  • Notes the EU AI Act as the most comprehensive binding framework, classifying AI by risk tiers with strict rules for high-risk applications
  • Discusses enforcement mechanisms, accountability requirements, and the role of national regulatory bodies across jurisdictions
  • Reflects the global trend toward formalized AI governance with divergent national strategies around liability, transparency, and prohibited uses

## Privacy & Cybersecurity Bulletin

October 18, 2022

Laws governing technology have historically focused on the regulation of information privacy and digital communications. However, governments and regulators around the globe have increasingly turned their attention to artificial intelligence (AI) systems. As the use of AI becomes more widespread and changes how business is done across industries, there are signs that existing declarations of principles and ethical frameworks for AI may soon be followed by binding legal frameworks. On June 16, 2022, the Canadian government tabled Bill C-27, the _[Digital Charter Implementation Act, 2022](https://www.parl.ca/DocumentViewer/en/44-1/bill/C-27/first-reading)_. Bill C-27 proposes to enact, among other things, the _Artificial Intelligence and Data Act_ (AIDA). Although there have been previous efforts to regulate automated decision-making as part of federal privacy reform efforts, AIDA is Canada’s first effort to regulate AI systems outside of privacy legislation.
