Summary

Fasken law firm analyzes the November 2023 amendments to Canada's Bill C-27, specifically the Artificial Intelligence and Data Act (AIDA), released by the federal government. The amendments introduce significant changes to how high-impact AI systems are defined, regulated, and overseen, including new transparency and accountability requirements for AI developers and deployers.

Key Points

  • The November 2023 amendments to AIDA introduce a revised definition of 'high-impact AI systems' with clearer criteria for what triggers regulatory obligations.
  • New requirements include mandatory impact assessments, transparency obligations, and mitigation measures for organizations developing or deploying high-impact AI.
  • Amendments strengthen enforcement mechanisms, including expanded powers for the AI and Data Commissioner to investigate and penalize non-compliance.
  • The revised bill attempts to align Canada's AI regulatory approach more closely with international frameworks, particularly the EU AI Act.
  • The amendments reflect ongoing stakeholder feedback and represent a significant evolution from the original AIDA text introduced with Bill C-27 in 2022.

On November 28, Minister of Innovation, Science, and Industry François-Philippe Champagne presented the House Standing Committee on Industry, Science and Technology (the "Committee"), which is studying Bill C-27, with the text of the Government's [proposed amendments](https://www.ourcommons.ca/content/Committee/441/INDU/WebDoc/WD12751351/12751351/MinisterOfInnovationScienceAndIndustry-2023-11-28-Combined-e.pdf) to the _Artificial Intelligence and Data Act_ (AIDA). Bill C-27 successfully passed second reading and was subsequently referred to the Committee in April. Minister Champagne had provided the Committee with a description of the Government's proposed amendments last month, which we had covered in a [previous bulletin](https://www.fasken.com/en/knowledge/2023/10/bill-c-27-federal-government-to-propose-further-amendm
